ORDER BELOW EXH.01
On hearing advocate for accused, it reveals that total six separate
complaints are filed against the accused by same complainant pertaining to same
transaction and Agreement. Out of six matters, complainant has adduced
evidence in 5 matters. Complainant has to adduce evidence in
C.C.No.736/SS/2020.
2. It is the contention of the advocate for the accused that his defence
will be disclosed while conducting cross examination in five matters which may
be the reason for modification of evidence or filling up the lacunas in evidence
brought in cross examination in those five matters. Indeed in a trial for cheque
bouncing cases the defence are very limited. Therefore, the statement made at
bar appears genuine. Disclosure of defence in earlier five matters may reflect or
harm the defence of the accused in last sixth matter in which complainant has
not adduced evidence. Therefore, even though there is separate cause of action
for all these matters, it would be just and proper to go with all these cases once
at a time. Hence, I pass following order.
ORDER
1. All these matters be heard together in common with permission to
lead separate evidence in each case.
2. Complainant to take appropriate steps to lead evidence in
C.C.No.736/SS/2020.
3. All matters are adjourned till 26.12.2025.
4. Order dictated and pronounced in open court.
5. Order be uploaded on Court Web Portal.
