ORDER ON BAIL APPLICATION
IN C. R. NO.185/2025 (DHARAVI P.S.)
1. Perused record. Heard both the sides.
2. The present application is filed under Section 480 of B.N.S.S., for bail
mainly on the grounds that accused are innocent and falsely implicated.
Investigation relating to accused persons is over. Other accused already released on
bail. No offence, as alleged made out. Accused are ready to remain abide by the
conditions, if any, imposed, etc.
3. The Investigating Officer, Ld. A.P.P. objected to it stating that allegations
are serious. One of the offence is triable by Court of Sessions. Grievous hurt is
caused to public servant while performing his duty. Accused are having criminal
antecedents and as investigation is in progress and there is possibility of tampering,
etc. Therefore, application shall be rejected.
4. From the record it is clear that accused persons caused grievous hurt to the
informant/public servant. The investigation is in progress. Offence is triable by
Court of Sessions. The other accused released on bail, mainly on the basis of fact
that his board examinations are going on. The ground of parity is not available to
present applicants, for this reason. The documents produced by Investigating
Officer and medical record in support of it shows that there is substance in the
objections raised by the Investigating Officer.
5. The investigation is still going on. There is possibility of tampering and
absconding. No justifiable reason found or pleaded by the applicants. Considering
all these observations and facts noticed, following order -
ORDER
Applications is rejected.
