ORDER BELOW BAIL APPLICATION, EXH.5
1. Perused record. Heard both the sides.
2. The present application is filed under Section 437 of Code of
Criminal Procedure, for bail, by Mr. Mayurkumar Thakorbhai Patel,
mainly on the grounds that he is innocent. Now the investigation is over
and charge sheet has been filed. There transpired nothing against him
during investigation. He is ready to remain abide by the conditions, if
any, imposed, etc. Ld. A.P.P. objected to it stating that there transpired
involvement of the accused in the allegations. The amount involved is
high. There is possibility of tampering, etc.
3. The summary of the first information report, is that informant was
lured by unknown persons informing that he have to complete certain
easy tasks and earn handsome income. Falling prey to the offer he
invested about Rs.20 lacs and then noticed fraud. Therefore, he lodged
report against unknown persons.
4. The charge sheet reflects that certain amounts were transferred in
the account of applicant. However, later on those amounts again
transferred to third person. There is doubt accrued about the actual
involvement of the applicant. Moreover, investigation is over and charge
sheet has already been filed. Other accused is already on bail.
5. The evidence is mainly in documentary and electronic form in
custody of third persons. It is already collected. The possibility of
tampering is almost nil. Accused is ready to remain abide by the
conditions and the conclusion of trial will take much time.
6. Considering all these aspects and facts and circumstances and
reasons assigned in the bail application, I am of the opinion that
application needs to be allowed, hence following order -

ORDER
a. Application is allowed and accused Mr. Mayurkumar Thakorbhai
Patel, is released on bail on his furnishing P.B. and S.B. of Rs.15,000/-.
Permission granted to deposit cash security instead of surety bond.
b. Accused shall furnish his detail address and proof thereof.
