Heard advocate for the complainant. Perused written notes of
argument. Accused No.2 and her advocate absent since last so many
dates. Already right of cross examination for the accused came to be
closed vide order dated 28.06.2023 below application Exh.17. Statement
of accused to be recorded under section 313 of Code of Criminal
Procedure was also dispensed with considering the absence of accused.
Today also accused and her advocate Anjali Nimkar absent. Accused was
released on cash bail of Rs.5,000/-, but jumped the bail conditions.
Hence, I pass following order.
O R D E R
1) The cash bail amount deposited by the accused stands forfeited and
be credited to the Government Account.
2) Issue standing Non Bailable Warrant against the accused.
3) The right of advancing argument by the accused stands closed.
4) Matter be posted for delivering Judgment in absence of accused on
next date.
5) Order dictated and pronounced in open court.
6) Order be uploaded on Court Web Portal for the knowledge of the
accused and advocate.
