FURTHER ORDER BELOW EXH.1
1. The present application is filed under Section 13 of Registration of Births
and Deaths Act, 1969.
2. It is contended that applicant is resident of Dharavi, Mumbai, and his
father named as Mr. Jangliprasad Ghanshyamdas Kuril, died on 02.03.2019, at
Sion Hospital, Mumbai. He is legal heir of his father, but not registered the death
of his father with respondent due to inadvertence and not knowing the legal
procedure of case at relevant time. The medical certificate referred his cause of
death as Congestive Cardiac Failure with Accelerated Hypertension. His last rites
were performed at Hindu Smashan Bhumi, Dharavi, Mumbai. He is in need of
death certificate for various reasons. Therefore, present application for issuing
direction, for registration of death of the father of the applicant.
3. The application is supported by affidavits of applicant and other relatives.
The documents produced i.e. copies of Ration card, electricity bill, Aadhar Cards
of applicant and deceased, proves relationship between the parties. The certificate
issued by hospital and local authority and other documents clearly supports the
fact of death. Considering these aspects and the necessity of the certificate
expressed by applicant, I am of the opinion that there is no hindrance in allowing
the application. Therefore, order :
ORDER
a. Application is allowed.
b. Respondent is directed to register the death of father of applicant named as
Mr. Jangliprasad Ghanshyamdas Kuril, as 02.03.2019, in its record on payment
of necessary fees by the applicant and issue death certificate.
c. Copy of this order shall be given free of cost to the applicant.
