ORDER BELOW APPLICATION EXH. 14
1. This is an application for recalling of process filed on the
ground of no jurisdiction to try this case by this court.
2. The complainant objected the application vide detailed
reply dated 24.11.2022.
3. Heard both sides.
4. So far as ground for recalling of process is concerned, the
cheques in question are presented by the complainant in his bank
named syndicate bank, Santacruz (E) branch which falls within the
jurisdiction of this court. Secondly, once the process is issued it can not
be recalled back by the Magistrate who issued the process. This is the
settled law. I do not found legal merits in the application. Hence, I pass
following order.
O R D E R
1) Application is rejected.
2) Order dictated and pronounced in open court.
