1. Perused record. Heard.
2. The present application is filed under Section 340 of Code of
Criminal Procedure, for initiating proceedings for perjury against
respondents, alleging that they filed certain forged documents before
local authority and obtained property in their name.
3. The Section 340 of Code of Criminal Procedure, can be invoked by
court before whom the offence of perjury took place and that too where it
is expedient to do so in the interest of justice. As stated above it is alleged
that respondents forged documents before local authority and not before
this court. Neither first nor second basic requirement of protection of
interest of justice satisfied. Application is vague. The basic requirements
are missing. Therefore, following order -
ORDER
Application is rejected.
