1. Applicant/accused has filed this application to deliver the
mobile worth Rs.1,47,699/- to him on any conditions. Perused
application and say of I.O. and Ld. A.P.P. Heard both sides. The I.O. have
no objection to deliver the seized vehicle to the applicant on conditions.
Hence, order:
ORDER
1. The seized mobile worth Rs.1,47,699/- be delivered to applicant
on executing supurtnama (indemnity bond) of same amount
before the I.O. on the following conditions namely:
2. Accused shall not dispose the said mobile till the conclusion of
the trial.
3. Investigating officer is directed to take appropriate colour
photographs of the seized property and to prepare panchanama
of the same before handing over it in favour of the applicant and
further directed to produce the panchnama, photographs and
supurtnama before the Court alongwith charge-sheet.
4. Present proceeding be merged in the main proceeding.
