1. Perused record. Heard Ld. Adv. for the accused. Heard Ld. A.P.P.
2. The present application is filed under Section 437 of Code of Criminal
Procedure, for bail mainly on the grounds that accused is innocent.
Investigation is over and charge sheet already filed. No offence as alleged by
prosecution made out. Accused is ready to remain abide by the conditions, etc.
Ld. A.P.P. objected to it stating that investigation though over offence is
serious. There is possibility of tampering and absconding. Therefore,
application shall be rejected.
3. It is alleged that accused attempted to kidnap minor girl and was found
going with her to some place. Some persons apprehended him and handed over
to police. Then father of child lodged report. Investigation completed and
present matter is fixed for committal. It is contended that no offence punishable
under Section 363-A of Indian Penal Code, made out. In view of allegations
there is doubt over the applicability of the said punishing provision. Further
investigation is over. Accused is in custody since long. He is ready to remain
abide by the conditions. It appears that offence is triable by this Court itself.
Accused is ready to remain abide by the conditions. The conclusion of trial will
take much time. Considering all these aspects and facts and circumstances and
reasons assigned in the bail application following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.10,000/-. Permission granted to deposit cash security instead of surety bond.
c. Accused person shall furnish his detail address and proof thereof.
d. Time of one month granted to furnish S.B.
