1] The complainant submitted that the accused no.1 continuously
defaming bollywood film industry since last couple of month as a hub of
nepotism, favouritism etc. through her tweets from her official twitter and
TV interviews. She is creating divisions between Hindu Artists and Muslim
Artists. She has tweeted very objectionable comments which has not only
hurt his religious sentiments but also the feeling of many film colleagues.
The accused no.2 has also made an objectionable tweet to spread communal
hatred amongst Hindus and Muslim Community through her tweet. The
Bandra police station did not take cognizance. Therefore, the complainant
has filed the present complaint in the Court and prayed to investigate the
matter u/s.156(3) of the Cr.P.C.
2] Perused the complaint, heard the advocate of complainant
alongwith the documents filed on record. On prima facie perusal of
complaint and submission I found the cognizable offence has been
committed by the accused. Total allegations are based upon comment on
electronic media i.e. tweeter and interviews. The accused used social media
like tweeter. The thorough investigation is necessary by the expert. The all
offences alleged and levelled against the accused are cognizable. Search and
seizure is necessary in this case. In such circumstances, I found it is to be

proper to pass order u/s.156(3) of Criminal Procedure Code. Hence, I pass
the following order.
ORDER
The proceeding be sent towards the concerned police station
u/s.156(3) of Criminal Procedure Code for necessary action and
investigation.
