2. Heard advocate for the accused.
3. No steps taken till date by the complainant. The case is pending
since year 2018. No say filed to the application for dismissal of complaint
filed by the accused nor complainant or advocate remained present and taken
steps. Keeping the file pending years together without proceeding further
taking appropriate steps by the complainant is unjustified.
4. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case. Hence, I
pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide section
256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section 138 of
Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
