ORDER BELOW APPLICATION OF APPLICANT/ACCUSED SEEKING
PERMISSION FOR RENEWAL OF PASSPORT
1] This is an application filed by applicant/accused Sunil Sunkappa
Jadhav in connection with C.C. No.1989/PW/2019 (CR. No. 385/2018)
registered for the offences u/s. 324, 354, 323, 143, 144, 147, 149 of I.P.C. at
Dharavi Police Station seeking permission for renewal of passport.
2] The applicant submits that he is holding passport which expired on
20/03/2017 and hence he is seeking permission for renewal of the same. He
has filed copy of relevant page of passport showing details on record.
3] The Investigating Officer and Ld. APP filed say and submitted that
the offence is serious one. If permission is granted, accused may abscond and
trial may be delayed. Hence, prayed to reject the application.
4] Perused application, documents, say and affidavit in support of
application. Heard advocate for applicant. The applicant who as per entry in
application also his own contention is permanent resident of Mumbai, is not
charged for heinous crime. Verified copy of Aadhaar Card is filed on record.
Since, he is represented by pleader. Hence, I do not find that the progress of
the case would be hampered, if he is granted permission for renewal of
passport.
5] Considering the above, I deem fit to allow the application as
follows:

O R D E R
i] The applicant/accused Sunil Sunkappa Jadhav is hereby given
no objection for renewal of passport which be considered by the
passport authority in accordance with law.
ii] The applicant/accused shall not leave India without prior
permission of the Court.
