ORDER BELOW APPLICATION OF APPLICANT/ACCUSED SEEKING
PERMISSION TO TRAVEL ABROAD
1] This is an application filed by applicant/accused Sunkappa
Gurappa Jadhav in C.C. No.1989/PW/2019 chargesheeted for the offences
u/s.324, 354, 323, 143, 144, 147, 149, 34 of I.P.C. seeking permission to travel
abroad.
2] The applicant submits that he intends to travel abroad to Europe
more specifically at Switzerland and Italy in the month of June 2021
(tentatively 12th June 2021) for 1520 days alongwith his family for holiday
purpose. He has filed copies of relevant pages of passport showing details on
record and also filed copy of itinerary on record.
3] The Investigating Officer and Ld. APP filed say and submitted that
the offence is cognizable. If permission is granted, accused may abscond and
not available for trial. Hence, prayed to reject the application.
4] Perused application, documents annexed thereto and say of Ld.
APP. The applicant who as per entry in document also his own contention is
permanent resident of Mumbai, is not charged for heinous crime. Verified copy
of Aadhaar Card is annexed with the application. Since he is represented by
pleader. I do not find that the progress of the case would be hampered, if he is
granted permission to go abroad for period prayed. Apprehension of
prosecution can be addressed by imposing condition.
5] Considering the above, I deem fit to allow the application as
follows:

O R D E R
i] Permission is granted to the applicant/accused Sunkappa
Gurappa Jadhav to travel abroad to Europe at Switzerland and
Italy in the month of June 2021 i.e. from 11/06/2021 to
30/06/2021 strictly restricted for purpose specified in
application.
ii] As a condition precedent, he shall furnish undertaking to attend
the matter during his period of absence through his pleader
without disputing his identity.
iii] The applicant is directed to deposit cash of Rs.10,000/ (Rupees
Ten Thousand only) against security for the same. The applicant
can withdraw it after his arrival.
iv] The applicant to report his arrival in India to the Court within
15 days of his arrival.
