ORDER BELOW BAIL APPLICATION, EXH.8
1. Perused record. Heard both the sides.
2. The present application is filed under Section 437 of Code of
Criminal Procedure, for bail mainly on the grounds that applicant/accused
is in jail since long. Investigation is over. Charge sheet is already filed.
There found no evidence against him. The amount allegedly obtained is
already refunded to the informant. Applicant is ready to remain abide by
the conditions, etc.
3. Ld. A.P.P. objected to it mainly on the grounds that the allegations
are serious and there found sufficient material against the present
applicant. There is prima facie evidence regarding involvement of the
accused. Though investigation is completed, charge sheet is filed. There is
possibility of absconding of accused and tampering. Therefore,
application shall be rejected.
4. Accused is in custody since long. Investigation is over and charge
sheet already filed. Amount is also recovered. Accused is ready to remain
abide by the conditions. Offence is triable by this court itself. Though
applicant is resident of Andhra Pradesh State, he is ready to furnish his
details of residence and other particulars. The conclusion of trial will take
much time. Further, pre-trial detention not justified for the reasons
discussed above. Accordingly, following order -
ORDER
a. Application is allowed.
b. The above accused/applicant Mr. Nagaraju Appalakhmi Budumuru,
is released on bail on his furnishing P.B. and S.B. of Rs.30,000/-. Cash
security allowed in substitution of S.B.
c. Permission granted to furnish one or more sureties for the amounts
of surety bond ordered.

d. It is further directed that the accused person shall also furnish his
detailed address, name and address of his parent and sureties, in a printed
format, along with his address and I.D. proof.
