Order Below Exh. 1
1. The case is pending since 2018. It is fixed for appearance of
the accused. The prosecution failed to secure the presence of the accused.
Thus, the case is placed in Special Drive in view of Letter of Hon'ble High
Court bearing No. B(Gen)1001/2021/880 dtd. 16.07.2021 with
endorsement of office of Hon'ble CMM bearing Inward No. 8720/2021.
2. The case is summarily triable if the nature of offences is
considered. Ample opportunity has been given to the prosecution. No
fruitful purpose will be served by keeping the matter pending on board.
Hence, there is sufficient ground to stop the proceeding.
3. Therefore, proceeding is stopped u/s. 258 CrPC. Seized
Articles will not be in usable condition. Hence, it will be proper to destroy
the same. Accordingly, following order is passed.
O R D E R
i] The proceeding is stopped u/s 258 of Cr.P.C. The accused
stand released from the offence punishable u/s 122 of M.P. Act
ii] The bail bond of the accused stand cancelled.
iii] Seized articles be destroyed.
iv] BW/NBW issued, if any, be returned without execution.
v] Case papers be filed.
