COMMON ORDER BELOW EXHS.43 AND 44
1. Perused record. Heard both the sides.
2. By way of these applications the applicants/accused persons sought
return of properties i.e. mobile phones, various documents, currency
notes, certain other articles and Skoda car bearing registration No.TN-10-
P-2399, model Laura.
3. From the contents of the charge sheet it is clear that all the mobile
phones and hardware is sent for Forensic examination, therefore, those
articles can not be returned. Except Skoda car bearing registration
No.TN-10-P-2399, model Laura, other documents constitutes evidence,
so also there is possibility of tampering of those articles, therefore, those
also can not be returned.
4. Considering the above discussed facts and circumstances and legal
aspects of the matter, following order -
ORDER
a. The application, Exh.43, is rejected.
b. Application, Exh.44, is partly allowed to the extent of Skoda car
bearing registration No.TN-10-P-2399, model Laura and the P.S.O.,
Cyber P.S. (West Division), B.K.C., Mumbai, is directed to handover the
custody of the said property seized, to the applicant on his executing
indemnity bond of Rs.5,00,000/-.
