ORDER BELOW EXH.1
1. Taken up in Special Drive for petty cases. Accused Mr. Advait
Milind Shetty, present. Ld. A.P.P. present. Perused record and application
filed by said accused for discharge.
2. The alleged offences are triable as summons case. From the record
it is clear that allegations are vague and the basic requirements to prove
the charge are missing. There is substance in the contents of the
application filed by accused. Further, it can be inferred from the whole
record that the final report even if, accepted by accused as it is, no
conviction is warranted. Considering all these factual and legal aspects,
there is no point in proceeding further with the present matter. Therefore,
following order :
ORDER
A. The proceeding stopped under Section 258 of Code of Criminal
Procedure and accused are discharged.
B. Cash security, if any, deposited shall be refunded to the accused, if
claimed within one year from today.
C. After one year the cash security amount be forfeited to the
Government. Liberty granted to the accused to claim it even after
one year by applying to that effect.
