ORDER BELOW APPLICATION FOR REGISTRATION OF BIRTH
1] This is an application filed by applicant Mohammed Rizwan
Abdulmajid Shaikh with contention that he was born on 29/05/1986 at home
situated at G140, A. K. Gopal Nagar, Sant Kabir Marg, Dharai, Mumbai
400017. Due to ignorance of law his parents could not get registered his birth
to the Municipal Authority within stipulated period.
2] The respondent i.e. Medical Officer of Health, G/North Ward,
Dadar W, Mumbai has filed report and submitted that the birth of Mohammed
Rizwan Abdulmajid Shaikh born on 29/05/1986 to Mr. Abdul Majid Shaikh
and Mrs. Haseena Begam Abdul Majid Shaikh is not registered with this office.
The said officer further submitted that to scrutinize the proposal and necessary
order be passed.
3] Alongwith this application, the applicant has filed on record his
affidavit stating every facts as per his application and enclosed verified copies
of his Aadhaar Card, PAN Card, School Leaving Certificate, Bonafide Certificate
issued by school authority, relevant page of gazette on record. Also, the

applicant has filed on record affidavits of Mr. Abdul Majid Saijad Shaikh –
father of applicant and Mrs. Haseena Begam Abdul Majeed Shaikh – mother of
applicant who on oath stated that the applicant was born on 29/05/1986 at
home. Their verified copies of Aadhaar Card, Election Card, Ration Card are
filed on record as proving of their identify and address. Also, the applicant has
filed on record affidavit of Mr. Gorepriya Shaikh Alauddin Shaikh – neighbour
of applicant who on oath stated that the applicant was born on 29/05/1986 at
home. Verified Aadhaar copy of witness is filed on record as proving of his
identify and address.
4] On perusing the application, documents of the applicant in support
of h पप application, affidavits of witnesses and report of BMC, this Court does
not find any hesitation to accept that 29/05/1986 is true and correct date of
birth of applicant. Hence, proceed to pass following order.
ORDER
1 The application is allowed.
2 The concern authority 'The Registrar, Birth and Death, G/North
Ward, Dadar (W), Mumbai – 400 028' is directed to take entry of the date of
birth i.e. 29/05/1986 ( Twenty Nine May Nineteen Eighty Six ) of Mohammed
Rizwan Abdulmajid Shaikh son of Mr. Abdul Majid Shaikh and Mrs. Haseena
Begam Abdul Majid Shaikh, in their register on accepting the fees as per the
rules.
