ORDER BELOW BAIL APPLICATION NO.1282/2022
1. Perused record. Heard both the sides.
2. Accused filed this application under Section 437 of Code of
Criminal Procedure for bail. The main grounds assigned are he is falsely
dragged in this matter. Investigation is completed and charge sheet is also
filed. The material relied by prosecution collected during investigation is
doubtful. Other accused persons already released on bail. He is ready to
remain abide by the conditions and he furnish security as per order of this
court. He is permanent resident of Mumbai.
3. Ld. A.P.P. objected to it stating that offence is serious. Investigation
though over there found sufficient material constituting prima facie case.
There is possibility of tampering and absconding of accused.
4. It is alleged that applicant/accused along with other accused
persons assaulted informant with knife and caused serious injuries. Now
investigation is over and charge sheet is filed. Accused is in custody since
07.02.2022. He is ready to remain abide by the conditions. Other accused
persons are already on bail. No doubt some serious role is attributed to the
accused, but as investigation is completed and other accused are on bail
the grounds assigned deserves due consideration.
5. Further, accused is ready to remain abide by the conditions.
Offence is triable by this court itself. The commencement of trial and its
conclusion will take much time. There is no point in keep the accused in
detention. Considering all these aspects and facts and circumstances and
reasons assigned in the bail application following order.
ORDER
a. Application is allowed and he is released on bail on his furnishing
P.B. and S.B. of Rs.25,000/-. Permission granted to deposit cash security

instead of surety bond or two or more sureties for the amount of bail bond
ordered.
b. Accused shall furnish his detail address and proof thereof.
