1. Perused record. Heard both the sides.
2. The present application is filed under Section 437 of Code of
Criminal Procedure, for bail, mainly on the grounds that accused are
innocent and arrested only on the ground of suspicion. There is no
recovery from them or any other incriminating material traced during
investigation. Now investigation is over and charge sheet has been filed.
The fundamental right of liberty of accused has been curtailed. Accused
presumed to be innocent unless proved and hence, they can not be
detained further, etc. Therefore, they shall be released on bail.
3. Ld. A.P.P. objected to it stating that offence is serious. Active
involvement of the accused persons transpired in allegations. They forged
and attempted to cheat the informant by executing documents, shown to
be court record. Previously also accused were held in the same case.
There is possibility of tampering and absconding besides repetition of
offence. Therefore, application shall be rejected.
4. It is alleged that accused persons forged various documents relating
to court proceedings and seals, etc. by representing a fake person to be
officer of the court. The active involvement noticed in the incidence.
There is enough material collected during investigation to connect the
accused persons with the allegations. It is also came on record that they
repeated such act.
5. There is every possibility of absconding of accused and tampering.
The possibility of repetition also can not be negated. The grounds
assigned are wrong and incorrect. On the basis of these grounds no case
for bail, even after filing of the charge sheet made out, hence order -
