ORDER BELOW EXHIBIT - 01
1. Today the matter is taken before this Court as accused is in custody
since long. Perused record. The present report is filed against the
accused in respect of an offence punishable under section 8 (c) r/w 27 of
Narcotic Drugs and Psychotropic Substances Act, 1985.
2. The record shows that allegations are vague. It is alleged that
accused was arrested on the spot and on the basis of smell and other
accompanied circumstances it is presumed that accused was found
consuming Ganja. Except this bare and bald oral allegation there is
nothing on record. The report of chemical analyser is not on record.
Even neither samples taken nor any compliance done for the said purpose.
Rather, it is contended that the articles seized from the person of accused
were immediately destroyed. The basic requirements are missing,
therefore, following order :
ORDER
A. The proceeding stopped under section 258 of Code of Criminal
Procedure.
B. The accused is discharged.
C. Accused shall be released forthwith if not required in any other
offence.
