ORDER BELOW BAIL APPLICATION
IN C. R. NO.411/2024 (Cyber P.S. West Division)
1. Perused record. Heard both the sides.
2. The present application is filed by Mr. Pritin Sangma S/o. Kolish
Marak, under Section 480 of Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.),
for bail, mainly on the ground that he is innocent and falsely implicated in
the matter. Investigation relating to him is over. He is ready to remain abide
by the conditions, if any, imposed. There are dependents on him and he is
only earning member of his family, etc. Investigating Officer and Ld.
A.P.P. objected to it stating that investigation is in progress and there is
possibility of tampering. Active role of the accused transpired in the matter.
Therefore, bail application shall be rejected.
3. The summary of the first information report, is that some unknown
persons approached informant for investment. Lured by offers made the
informant invested an amount of Rs.40,00,000/-. Later on he is found to be
defrauded by those unknown persons. The record of investigation shows
that the present applicant withdraw the amount transferred to the account of
another accused Mr. Anurag Prasad, who is released on bail. The record
shows the involvement of the present applicant in the allegations, however,
the main accused persons appears to be different persons, who incited the
informant to deposit the amount. The investigation relating to present
applicant is over.
4. Accused is in custody since 28.01.2025. The evidence is of
electronic and documentary nature, which is mainly in custody of the third
persons. As such possibility of tampering is almost nil. The other accused
is already released on bail. Accused is ready to remain abide by the
conditions, if any, imposed. Accused is permanent resident of Asam and
owns landed properties, etc. there.

5. Offence is triable by this Court itself. The conclusion of
investigation, filing of charge-sheet and consequent conclusion of trial will
take much time. Certain conditions can be imposed to address the
objections raised by Investigating Officer and Ld. A.P.P. Considering all
these aspects and facts and circumstances and reasons assigned in the bail
application following order -
ORDER
a. Application is allowed.
b. Accused Mr. Pritin Sangma S/o. Kolish Marak, is released on bail on
his furnishing P.B. and S.B. of Rs.15,000/- and depositing Rs.5,00,000/-
(Rs. Five Lacs only) in the court. Permission granted to deposit cash
security instead of surety bond.
c. Informant is at liberty to withdraw the amount of Rs.5,00,000/-
deposited by the applicant.
d. Accused shall furnish his detail address and proof thereof.
