1. The case is pending since 2016. It is fixed for appearance of
the accused. The prosecution failed to secure the presence of the accused.
Thus, the case is placed in Special Drive in view of Letter of Hon'ble High
Court bearing No. B(Gen)1001/2021/1611 dtd. 26.11.2021 with
endorsement of office of Hon'ble CMM bearing Inward No. 15339/2021.
2. The case is summarily triable if the nature of offences is
considered. Ample opportunity has been given to the prosecution. No
fruitful purpose will be served by keeping the matter pending on board.
Hence, there is sufficient ground to stop the proceeding.
3. Therefore, proceeding is stopped u/s. 258 CrPC. Accordingly,
following order is passed.
O R D E R
i] The proceeding is stopped u/s 258 of Cr.P.C. The accused
stand released from the offence punishable u/s 4,12 of
Maharashtra Prevention from Gambling Act.
ii] Bail bonds of the accused stand cancelled.
iii] Seized cash amount be credited to the State. Seized playing
cards be destroyed.
iv] BW/NBW issued, if any, are called back without execution.
v] Case papers be filed.
