ORDER
1. The applicant is praying for return of gold chain weighing 6
grms, gold lockets weighing 6 grms and a gold ring weighing 1 grm seized
by Vakola Police Station in C. R. No.188/2022 registered u/sec. 380 of
IPC.
2. The Investigating Officer has no objection to return the
property to the applicant.
3. The applicant submitted that theft took place at her house and
gold ornaments were stolen. Report about theft was lodged. She is praying
for return of above mentioned ornaments seized by the police. She has
produced copies of FIR, seizure panchanama and Aadhar Card in support
of her version. She has also produced no objection from the first informant
to hand over the property to her. No one else has claimed the custody of
the seized ornaments. Further, it will not be proper to keep the seized
ornaments at the police station for longer period. Thus, there is no hurdle
to handover the seized ornaments to the applicant by imposing conditions.
In the result, following order is passed :
ORDER
1. The custody of gold chain weighing 6 grms, gold lockets
weighing 6 grms and a gold ring weighing 1 grm seized by Vakola
Police Station in C. R. No.188/2022 registered u/sec. 380 of IPC be
returned to the applicant.

2. The applicant is directed to furnish indemnity bond of
Rs.58,000/.
3. Applicant is directed not to transfer, alter, dispose or hand
over the said seized property to third person without prior
permission of Court and to produce it before the Court,
whenever required for trial.
4. The investigating officer is directed to take photographs of the
ornaments at the cost of the applicant and to produce the
photographs and indemnity bond alongwith the final report.
