Order Details: Order Below EX 1 Pdf Text: C. C. No. 1256 PW 2021 State Vs Ganesh Shahu Nagar Police Station CNR No.MHMM18-002846-2021 ORDER BELOW EXH.1 The accused several times sent applications through jail authority and pleaded guilty. His plea is voluntary. The accused has stolen mobiles of value about of Rs.31,000/-. He is in jail since the month of June, 2021. He prayed for leniency in the application and submitted that he should be released by awarding sentence he has already undergone. Considering the nature of offence, the property involved and the period undergone by the accused, following order: ORDER A. Accused is convicted under Section 241 of the Code of Criminal Procedure, for an offence punishable under Section 380 of Indian Penal Code and sentenced to suffer rigorous imprisonment for three months for an offence punishable under Section 380 of Indian Penal Code B. He is entitled to set off as per Section 428 of the Code of Criminal Procedure. As he is in jail since 01.06.2021, the punishment has already been undergone by him, therefore, he shall be released forthwith if not required in any other offence. C. The property seized shall be handed over to informant. D. Copy of this order to be given free of cost to the accused.
