ORDER PASSED BELOW EXH.-1
(Along with order on B.A. filed by Accused Nos.3 and 4)
1. Accused persons present before this court. They are charged with the offence
punishable under Sections 376, etc. of the Indian Penal Code, which is
exclusively triable by the Court of Session.
2. Accused Nos.3 and 4, filed application for bail. Anticipatory bail already
granted to them during investigation, the copy of which is filed on record today.
In view of law laid down by Supreme Court in case of Sidharam Mhetre Vs State
of Maharashtra, they are released on bail on same terms and conditions as laid
down in the said bail order.
3. Prima facie case made out. Cognizance taken of the said offences. The copies
of the police report and other documents as specified in the Section 207 of the
Code of Criminal Procedure have been supplied to the accused. The case needs to
be committed to the Court of Session, for trial, hence following order :
ORDER
1. The case be committed to the Court of Session.
2. Accused is directed to appear before the Court of Session on 04/08/2022.
3. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Court of Session.
4. The Police Station Officer, Police Station Dharavi, be directed to
produce muddemal property in the Court of Session on or before
04/08/2022, positively.
5. The Public Prosecutor shall be notified of the commitment of the case to the
Court of Session.
6. Record and proceedings be sent to the Session Court, Greater Bombay.
