ORDER
1. This is an application filed by the applicant/accused viz.
MOHD JUBER USMAN GANI TANWAR for the permission of this court to
travel abroad from 13/07/2026 to 03/08/2026 for the purpose of
employment to Haj.
2. Ld. APP opposed the application by contending that, the
offence against accused is cognizable and non bailable in nature and
presence of accused is required for trial.
3. Accused alleged to have committed an offence punishable
under section420, 406 r/w.s. 34 of the I.P.C. He is on bail. The charge
against him has been framed. Therefore trial will not protract if permission
granted. No reason to reject the application. Therefore, I proceed to pass
following order :-
ORDER
1. Application is allowed.
2. Applicant/accused viz. MOHD JUBER USMAN GANI TANWAR is
permitted to travel abroad from 13/07/2026 to 03/08/2026
for the purpose of employment to Haj, subject to following
conditions -
(i) Applicant/accused shall remain present before the Court after
returning from abroad.

(ii) Applicant/accused to complete necessary formalities and this
permission shall not be deemed to be an alternative to any rules
or regulations which the applicant/accused is obliged to comply
with.
(iii) Applicant/accused shall file an undertaking that he will not
challenge the evidence recorded in his absence and his identity
deposed by witnesses.
(iv) Applicant/accused shall file an undertaking that he will remain
present through V.C. if required.
(v) Applicant/accused shall not misuse the liberty granted to him.
3. Issue letter accordingly to the concerned authority.
