The complainant had entered into a transaction to purchase a mobile phone on credit basis from accused No.1 with the loan provided by the accused No.2. There appears dispute of accounts settlement. There exists no intention to gain wrongfully. There is no question of entrustment of any property with the accused persons. Thus, even if the complaint admitted as it is, no offence made out.
