ORDER BELOW EXH.-15
Perused record. It reflects that, the respondent No.1 Mohan
Prahlad Malakari filed his application and seeking prayer of visitation
right to his minor daughters namely Riddhi and Siddhi. Respondent
No.1 submitted that, he is father and having constitutional right to visit
her minor children.
2. Applicant filed her say below (Exh.16) and contended that,
she has already sought prayer under section 18 of The Protection Of
Women From Domestic Violence Act, 2005 and seeking prayer of
protection from respondent No.1. She also contended that, the present
application is not maintainable before this court.
3. Record reflects that, being father respondent No.1 has right
to visit his minor daughters namely Riddhi and Siddhi. Applicant
contended issue of protection, in such situation visiting right can be
given to Respondent No.1 within the campus of this court in presence of
Judicial Clerk. Then purpose of this application would be suffice.
Considering facts and circumstances I pass following order.
ORDER
1 Applicant is directed to bring both daughters namely
Riddhi and Siddhi before this court on next date.
2 Respondent No.1 can visit daughters namely Riddhi
and Siddhi between 11.00 a.m. to 12.01 p.m. in
presence of Judicial Clerk of this court.
