ORDER BELOW APPLICATION FOR REGISTRATION OF BIRTH
1] This is an application filed by applicant Afreen Ayub Sayed with
contention that her daughter namely 'Jainab Ayub Sayed' was born on
13/03/2013 at home at the above mentioned address. Due to negligence and
unawareness of B.M.C. rules the applicant could not get registered the birth of
her daughter with B.M.C. Office.
2] The respondent i.e. Medical Officer of Health, G/North Ward,
Dadar W, Mumbai has filed report and submitted that the birth of Jainab Ayub
Sayed born on 13/03/2013 to Smt. Afreen Ayub Sayed and Shri. Ayub Yusuf
Sayed is not reported with their office. The said officer further submitted that
to scrutinize the case and necessary order be passed.
3] Alongwith this application, the applicant has filed on record her
affidavit stating every facts as per her application and affidavit of her husband
Mr. Ayub Yusuf Sayed and enclosed copies of her Aadhaar Card and Aadhaar
Card of her husband, doctor's certificate. Also, the applicant has filed on record
affidavits of witnesses Mr. Irshad Isharat Ali Sayyed and Mr. Mohammed
Ibrahim Fazle Haque wherein on oath stated to have been present at the time
of birth of Jainab Ayub Sayed daughter of applicant on 13/03/2013 at house

of applicant. Verified Aadhaar Card copies of witnesses are filed on record as
proving of their identify and address.
4] On perusing the application, documents, affidavit of the applicant
in support of the application, affidavits of witnesses and report of BMC, this
Court does not find any hesitation to accept that 13/03/2013 is true and
correct date of birth of daughter of the applicant. Hence, proceed to pass
following order.
ORDER
1 The application is allowed.
2 The concern authority 'The Registrar, Birth and Death, G/North
Ward, Dadar (W), Mumbai – 400 028' is directed to take entry of the date of
birth i.e. 13/03/2013 (Thirteen March Two Thousand Thirteen) of 'Jainab
Ayub Sayed' daughter of applicant Smt. Afreen Ayub Sayed and Shri. Ayub
Yusuf Sayed, in their register on accepting the fees as per the rules.
