ORDER BELOW EXH.1 IN C.C.NO. 290/PS/2018
Perused the record. It appears that the chargesheet is filed
u/sec. 279, 336 of I.P.C. and section 184 of M.V. Act. The record
further shows that till today, police machinery miserably failed to
execute summons on accused. Sufficient and considerable opportunity
as well as time is given to police machinery. Case is 5 years old. Hence,
in such situation, no purpose will be served by keeping it pending.
Therefore, in such facts & circumstances, the proceeding of the case is
stopped u/sec.258 of the Code of Criminal Procedure. The accused is
acquitted and his bail bonds, if any be canceled. Seized Yamaha
motorcycle bearing No. MH01AJ6022 be returned to it's original
owner, after due verification. It be closed.
