1. Applicant/accused Dilawar Ismail Shaikh is the owner of seized motor
vehicle two wheeler i.e. Burgman Street bearing no. MH01DQ3183 seized by the
Mahim Police, as the accused in the crime allegedly used the motorcycle while
committing the offence.
2. The applicant/accused sought interim custody claiming necessity being
owner and not involved in the offence. The applicant/accused has produced the
Affidavit, Copy of Motor Vehicle Registration Certificate, Copy of Aadhar Card and
copy of Insurance certificate. The accused seems to have primafacie committed the
offence.
3. However, the interim custody of the vehicle can be given to avoid the
damage and rusting to the vehicle on strict condition. Hence, following order.
ORDER
1. The Inspector of Mahim Police Station, if in possession of the motor vehicle
Burgman Street bearing registration No. MH01dq3183 shall hand over the
same to the present accused on his executing Indemnity Bond on nonjudicial
stamp paper of Rs.100/ for Rs.50,000/(Rupees Fifty Thousand Only)
undertaking to the effect that,
(a) he will not alienate, destroy, give on rent or part with the possession of
the above vehicle,

(c) That the applicant to furnish three photographs of the motor vehicle
from three different angles to the police station, which lateron to be filed
alongwith the final report in the Court by the police.
2. The applicant shall produce self attested copies of RC Book, Insurance,
License to the concerned police station.
