ORDER BELOW APPLICATION OF APPLICANT SEEKING NO OBJECTION
FOR RENEWAL OF PASSPORT AND PERMISSION TO TRAVEL ABROAD
1] This is an application filed by applicant/accused Kalyanan
Sundaram Swaminathan Kilakulam in C.C. No.19/SW/2012 seeking no
objection for renewal of passport and permission for travelling abroad to U.A.E.
2] The applicant submits that he is businessman and he intends to
travel abroad for urgent assignment at U.A.E. He is holding passport vide no.
J1743959 which is expiring on 19/10/2020. He has filed xerox copy of relevant
pages of passport showing details on record.
3] On the application say of complainant was called. The police of
Bandra police station filed report on record and submitted that the notice could
not serve to complainant as no address is found of the complainant co.
4] Perused application, documents and affidavit in support of
application. Heard advocate for applicant. The applicant who as per entry in
application also his own contention is permanent resident of Mumbai. He has
annexed verified copy of Aadhaar Card, PAN Card as proof of his identify and
address. The present matter is of private in nature. Since he is represented by
pleader I do not find that the progress of the case would be hampered, if he is
granted permission for renewal of passport.
5] However, so far as his prayer for permission to travel abroad is
concerned it is not supported by any travel schedule. The period for which he
desires to proceed to foreign destination is not mentioned in the application.
Mere, the travel ticket is annexed which also shows the date of travel was on

03/09/2020 which the period has already elapsed. After going through the
proceeding it shows the matter is stayed by Hon'ble Sessions Court and also
one writ is pending before Hon'ble High Court. As such the prayer to travel
abroad cannot be allowed.
6] Considering the above, I deem fit to allow the application as
follows:
O R D E R
i] The applicant/accused Kalyanan Sundaram Swaminathan
Kilakulam is hereby given no objection for applying for renewal
of passport which be considered by the passport authority in
accordance with law.
ii] The prayer of applicant/accused to travel abroad is rejected.
