ORDER PASSED BELOW EXH.1 This application is filed by the applicant namely Tanvir Abdul Razzak Shaikh for release of Royal Enfield motorcycle bearing No.MH47 AC3398, which is seized by the Kherwadi police station in connection with Crime No.206/2022 registered with said police station for the offence punishable under section 279, 336 of IPC and section 184 of M.V. Act. 2) Say was called from I. O. and A.P.P. I.O. has no objection. Ld. APP has an objection and submitted that it is essential at the time of trial. She prayed for rejection. 3) In support of his contention regarding ownership, applicant has filed on record xerox copies of FIR, statement, vehicle particulars, delivery notes, transfer of ownership and verified copies of office receipt and Aadhar card alongwith his affidavit. The applicant failed to file verified copy of RC book of motorcycle and as per transport authority, the owner of said vehicle is different person. Therefore, he is not entitled to get the custody of the vehicle. Under such circumstances, I pass following order : -- 1 of 2 -- 2 :: O R D E R O R D E R :: Application is rejected.
