This application is filed by the applicant namely Babubhai
Dharanshi Dewda for release of Activa scooter bearing registration No.MH
02DL6711, which is seized by the Nirmal Nagar in connection with Crime
No. 122/2022 registered with said police station for the offences punishable
under section 379 of IPC.
2) Say was called from I. O. and A.P.P. I.O. has no objection. The
Ld. APP has an objection and submitted that said muudemal is essential at
the time of trial. She prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record xerox copy of FIR and verified copy of RC book alongwith
his affidavit. The applicant is not the registered owner of the said vehicle.
Savji Jakhubhai Patel is the registered owner of said vehicle and he does not
appear in this application. Therefore, he is not entitled to get the custody of
the said muddemal. Under such circumstances, I pass following order :
