JUDGMENT ON ADMISSION
(Delivered on 14th day of June, 2021)
The police official of police station Bandra, Mumbai produced
accsued Majid Sajid Khan before the Court along with chargesheet for
alleged have been committed the offence punishable under Section 8 (c) of
the Narcotrics Drugs and Psychotropic Substances Act, 1985 which is
punishable under Section 27 of the Act. It is alleged by the prosecution
that on 13.06.2021 the accused found consuming Ganja which is
contravene illegal intoxicant substance at public place and thereby he has
committed the offence under Section 8 (c) which is punishable under
Section 27 of the Act. Initially the accused taken into Magistrate custody
till 15.06.2021.
2. Moreover, learned advocate Mr. Rahul K. Pandey appeared on behalf
of the accsued and filed pursis at Exh.4. It is submitted that the accused is
ready to voluntarily plead guilty. I also heard learned advocate for the
accused and accused in person. I also explained the punishment provided
under Section 27 of the Act which may extend to one year, or with fine
which may extend to Twenty Thousand rupees, or both. The accused
voluntarily plead guilty and submitted that he is knowing the consequences
of plead guilty.
3. Since the accused found consuming contravene illegal intoxicant
substance like Ganja at public place and also found in possession of article
for consuming the said contravene intoxicant substance, therefore, it is just
and proper to sentence him for the period of five days with find of
Rs.3,000/ (Rupees Three Thousand) in default of fine he will 15 days
simple imprisonment. Hence, I pass the following order :

O R D E R
1. Accused Majid Sajid Khan is convicted vide section 252
of The Criminal Procedure Code for the offence
punishable under Section 8(c) which is punishable
under Section 27 of the Narcotrics Drugs and
Psychotropic Substances Act, 1985. He is sentenced to
suffer Rigorous Imprisonment five days, and to pay
fine of Rs.3,000/ (Rupees Three Thousand only). In
default he is sentenced to suffer Simple Imprisonment of
15 (Fifteen) days.
2. The copy of the Judgment be given to the accused free
of cost.
(Judgment is pronounced in open court.)
