J U D G M E N T
1. The accused Soheb Makbool Shaikh alleged to have committed
offence u/s 379 r/w. 34 of IPC. The accused has pleaded guilty voluntarily.
The consequences of pleading guilty is explained to him. Thus, the accused
will have to be convicted.
2. The learned APP argued for maximum punishment. However,
there is no evidence of the previous conviction of the accused under the
said Sections available on record.
3. Heard the accused on the point of sentence. He stated that his
economic condition is not sound. He is in jail since long. He further stated
that it is his first offence and he assured that he will not commit any
offence in future.
4. Considering the plea of the accused and facts and circumstances
of the case, following order would meet the ends of justice.
ORDER
i] Accused Soheb Makbool Shaikh is hereby convicted for
the offence punishable u/s. 379 r/w. 34 of IPC of Indian
Penal Code and sentenced to suffer R.I. for 8(eight) months.
ii] The accused is entitled to claim set off u/sec.428 of Cr.P.C.
iii] The copy of the judgment be given to the accused free of cost.
