Cross-examination resumed on:-
31. It is true to say that Exh.23 and 24 are the cheqeus out of
those 12 cheques which are still in my custody which is mentioned in
cancellation deed and my reply notice. It is true to say that I did not
take permission of the accused before depositing the subject cheques.
It is true to say that before giving answer to my reply notice or even
before sending the notice the settlement talk was going on between
me and the accused. It is not true to say that in the settlement talks
we were agreed that I will not file any complaint against the accused
if he paid me the actual due amount of Rs.28,00,000/-. It is not true
to say that the D.D. was attached with the reply notice sent to
accused. It is true to say that despite the knowledge that the accused
had attached the D.D. along with the reply to the notice I have filed
the present compliant. I don’t remember that before sending the
notice dated 23.12.2019 the accused had sent me the image of the
D.D. on my whatsapp number.
32. It is true to say that there is no seal of the concern bank
and name of the signatory on Exh.25 and Exh.26. It is not true to say
that the accused has signed the deed of cancellation under pressure.
It is not true to say that there is no board resolution filed in the
present case and therefore I have no authority to file the present
complaint. Now the proceeding is shown to the witness there is no
board resolution in the proceeding. It is not true to say that
complainant is not maintainable since I have claimed the interest in
the notice. It is not true to say that I have filed false case against the
accused. It is not true to say that the notice issued to the accused is

not maintainable and therefore my complaint is also not
maintainable. It is not true to say that I have filed the complaint
against the accused in order to extort more amount than the liability
of the accused. It is not true to say that I am deposing false.
