This is an application for setting aside no cross order moved
by advocate for accused. Accused No. 3 present.
2. Application is strongly objected by the complainant.
3. Heard both sides.
4. Perused proceeding. Accused has not obeyed the terms and
conditions of consent terms. There is reason to believe that accused is
intending just to prolong the trial for no bonafide reasons. No legal
substance appears for setting aside no cross order. In fact considering
the act of executing consent terms, an inference can be safely drawn
that accused has no defence at all and as such prolonging the trial.
Hence, I pass following order.
ORDER
1. Application is without merit stands rejected.
2. Order dictated and pronounced in open court.
3. Order be uploaded on Court Web Portal.
