ORDER BELOW EXH.-1
The informant present before the Court. Ld. Advocate
Shri. B. C. Sharma for informant present before the Court. The
informant has filed the application for compounding the offence,
stating that, he do not want to lead any evidence. The informant also
filed on record the authority letter issued by J. Kumar-CRTG (JV)
company, which is at (Exh.-5).
2. Vakola police have filed the chargesheet under section
303 (2) r/w.s. 3 (5) of The Bharatiya Nyaya Sanhita, 2023 against
accused. Now according to the informant his company do not want to
proceed with the case. He filed on record the authority letter issued
by the company at (Exh.-5). The offence is compoundable. Therefore,
in view of (Exh.-3) to (Exh.-5) the case is componded and as per
provision of section 359 (8) of The Bharatiya Nagarik Suraksha
Sanhita, 2023 accused are acquitted. Their bail bonds stands
cancelled. The seized property be given to it’s lawful owner.
