The Hon'ble Bombay High Court directed that, from
27/02/2024 to till 03/03/2024 Special Drive for disposal of unattended,
petty, steal and ineffective cases be taken up. Therefore, today the case is
taken up for disposal in special drive. Accused alleged to have committed
an offence punishable under section 184 of M. V. Act, for which the
punishment of simple imprisonment not less than 6 months but to the
extend of 1 year and fine not less than I1,000/-, but which may extend to
I5,000/- has been provided for first offence. The alleged offence is
committed on 16/01/2023 and the chargesheet is filed alongwith delay
condonation application on 23/01/2024. Therefore, it appears that, as per
clause b of section 468 of Code of Criminal Procedure there is a bar for
taking cognizance of the present offence. Even no satisfactory explanation
has been given by the Investigating Officer. Therefore, the application for
condone the delay is hereby rejected and chargesheet is rejected. Accused
is hereby discharged and proceeding is closed.
