Order below application Exh3 for interim relief.
Perused the application, affidavit, documents and say of
respondent on record. Heard Ld. Advocates for applicant and
respondents at length.
2. The applicant's allegations shows that the applicant has
been suffered domestic violence at the instance of respondent.
Applicant submitted about domestic violence. She claims that
respondent is having 5 room premises, getting monthly
compensation and handsome salary and his income is more than
Rs.1,00,000/ per month. She prayed for direction to execute
proper bond with surety prevention by respondent, not to disturb
her peaceful possession, getting interim maintenance of
Rs.20,000/ for herself and Rs.10,000/ per month for each
daughter and son by name Pooja, Laxmi, Priya & Aakash and
compensation.

3. The respondent filed his reply at Exh09. He totally
denied all the contentions of applicant and submitted that the
applicant having three love affairs with Lavkush Radheshyam
Mishra, Guddu Prakash Mishra and Mangesh More. He next
submitted that he red handed caught the applicant with Vinay H.
Pandey i.e. her boyfriend and she spoiled his health. He further
submitted that he is getting Rs.300/ per day on daily wages. He
prayed for rejection with heavy compensatory cost.
4. After perusal of the Record, it appears that
respondent not directly admitted the relationship but in his
contentions he admitted the relationship and birth of their
children. Now the applicant is residing separately. The applicant is
claiming huge amount as maintenance. The applicant has not filed
the income documents of respondent. But, the respondent
admittedly declared his income as Rs.8,000/. It cannot be denied
the responsibility of mother of respondent. The four children are
with applicant and respondent has not filed any income proof of
applicant. Therefore, in such facts and circumstances, applicant is
entitled for interim maintenance only.
ORDER
1. Application is partly allowed.
2. The respondent is directed to pay Rs. 3,000/
jointly per month maintenance to applicant and her
four children from the date of the application.

3. Copy of this order be given to the applicant free of
cost.
