REASONS
The accused are produced before me through video conference.
Charge is framed against them, to which they voluntarily pleaded guilty.
Accused are in jail since 10.06.2020. Heard accused in person. They
submitted that lenient view may be taken as they are only earning member
of their respective families. Considering the nature of offence, antecedents
of the accused, age of accused persons and the period of detention already
undergone, I proceed to pass following order :
ORDER
i) Accused 1. Sudhir Lodi Chavan and 2. Ganesh Sandip
Golatkar are convicted under section 241 of Criminal
Procedure Code for the offence punishable u/sec. 461, 380
r/w 34 of Indian Penal Code. They are sentenced to suffer
R.I. for 6 months each, for each offence and fine of Rs.
5000/ each, for each section, in default of payment of fine,
he shall undergo further R.I. for 1 month each, for each
section.
ii) All sentences shall run concurrently.
iii) The accused are in jail since 10.06.2020. They are entitled to
get benefit of set off for the period of detention already
undergone vide under section 428 of Cr.P.C.
iv) Muddemal property be kept for trial of absconded accused.
v) Copy of this judgment be supplied to the accused free of cost.
vi) Copy be sent to concern police station for its compliance.
