ORDER BELOW EXH. NO.9
The applicant has filed this application seeking interim
maintenance of Rs.25,000/- per month from the respondent. Perused
application and say filed by the respondent. Perused documents and
affidavits of Assets and Liabilities filed by both the parties.
2. Heard Ld. Advocates for both parties. Perused written argument.
3. Admitted facts - The applicant is first wife of respondent. They
have minor children namely Alia and Zidan. The applicant and their
children are residing at matrimonial house. The respondent has married
with another woman namely Sophia and they have one son Zidwan. The
respondent and second wife and their son are residing separately.
4. The applicant has made allegations of domestic violence against
the respondent. She has filed affidavit in support of it. The copy of non-
cognizable report prima facie shows that there is domestic violence on
applicant on behalf of respondent. The medical documents shows that
the applicant needs medical treatment of her spines. There is no record
to show that she has independent source of income. The respondent in
Assets and Liabilities affidavit has stated in Clause No.F that his monthly
income is Rs.25,000/- and in Clause No.I of said affidavit has stated that
he is running business by name Freelancer Event Worker and generating
income from said business Rs.6,00,000/- annually. He has not given the
particulars of source of income of applicant. He has not filed any

credible documentary evidence to show that the applicant is earning.
The applicant needs money for her maintenance and education expenses
of her children. The respondent has filed certain photographs of
applicant. However, that does not shows that she is doing any business.
The respondent has not at all filed his bank statement. The applicant has
filed her bank statement. The credited amount in her bank statement is
not sufficient to maintain herself and her children. The respondent has
stated in affidavit of Assets and Liabilities that he has loan of
Rs.5,00,000/-. However, he has further stated that he has repaid
Rs.2,50,000/- towards the loan. However, there is no documents to
show about the said loan. Therefore, considering expenses of applicant
and the income of respondent, she is entitled for Rs.15,000/- per month
from the respondent. Hence, I proceed to pass the following order -
ORDER
a. Application is partly allowed.
b. From the filing of this application till the final disposal of this case
the respondent shall pay Rs.15,000/- per month to applicant for her
maintenance and for the relevant expenditure of her children.
c. Judicial Clerk shall forthwith submit the compliance report to the
Hon’ble High Court.
