1. Applicant Munnalal Ramlakhan Yadav is the owner of seized Auto
Rickshaw bearing no. MH02EW0118 seized by the Khar Police, as the accused in
the crime allegedly used the motor vehicle while committing the offence.
2. The applicant sought interim custody claiming necessity being owner.
The applicant has produced the Affidavit, copies of Fitness certificate of alleged
property, Permit, Insurance, FIR, Driving licence and Adhar Card of the applicant.
The accused seems to have primafacie committed the offence.
3. However, the interim custody of the vehicle can be given to avoid the
damage and rusting to the vehicle on strict condition. Hence, following order.
ORDER
1. The Inspector of Khar Police Station, if in possession of the auto rickshaw
bearing registration No. MH02 EW0118 shall hand over the same to the
present applicant on his executing Indemnity Bond on nonjudicial stamp
paper of Rs.100/ for Rs.1,30,000/(Rupees One Lakh Thirty Thousand
Only) undertaking to the effect that,
(a) he will not alienate, destroy, give on rent or part with the possession of
the above vehicle,
(c) That the applicant to furnish three photographs of the motor vehicle
from three different angles to the police station, which lateron to be filed
alongwith the final report in the Court by the police.
2. The applicant shall produce self attested copies of RC Book, Insurance,
License to the concerned police station.
