Order Details: Order Below EX 1 Pdf Text: 1 CC No. 186/N/2022 Mr. Santosh Dattarey Telge V/s Vakola PS ORDER 1. The applicant is praying for return of amount of Rs. 69,955/ seized by Vakola Police Station in crime No. 151/2022, registered u/sec. 419, 420 of IPC r.w. Section 66(C), 66(D) of Information Technology Act. 2. The applicant is the first informant in the case. It is submitted that the amount of Rs. 69,955/ was fraudulently debited and transferred from his account. He lodged report about the incident. 3. The I.O. admitted that the claimed amount belongs to applicant and he has no objection to return the amount to the applicant. 4. The applicant claims that he is entitled to received the amount seized in this case. He produced on record copy of FIR, Xerox copy of Bank Statement of applicant, Xerox copy of Bank Statement in which money is transferred and Adhar in support of his submission. There is no rival claim in respect of the said amount. Said amount belongs to the applicant and does not required for the purpose of investigation. No good purpose would served keeping the amount idle in the account. Applicant is entitled to receive the same. In the result, following order is passed : ORDER 1. The application is allowed. 2. The Account No.52210036897437 of Bandhan Bank freezed by the Vakola Police Station in Crime No.151/2022 for the offence under Section 419, 420 IPC is hereby defreezed and an amount of -- 1 of 2 -- 2 CC No. 186/N/2022 Mr. Santosh Dattarey Telge V/s Vakola PS Rs.69,955/ (Rupees Sixtynine Thousand Nine Hundred Fiftyfive only) be returned to the applicant. 3. The applicant is directed to furnish indemnity bond of Rs.70,000 /. 4. The investigating officer should furnish the indemnity bond along with the final report.
