This application is filed by the applicant namely Ganesh
Vithal Malvankar for release of Dell company laptop which is seized by
the Kherwadi police station in connection with Crime No.190/2022
registered with the said police station for the offence punishable under
section 379 of I.P.C.
2) Say was called from I. O. and A.P.P. The I.O. has no
objection. The Ld. APP has an objection and submitted that said
muddemal is required at the time of trial. He prayed for rejection.
3) In support of his contention regarding ownership, applicant
has filed on record verified copies of tax invoice & xerox copies of FIR,
statement, Aadhar card, PAN card, affidavit cum NOC of original
informant alongwith his affidavit. The applicant failed to state the
connection of Shriya Quality System Consultants Company with him.
Furthermore, he has not written his surname in readable handwriting.
Therefore, he is not entitled to get the custody of the said muddemal.
Under such circumstances, I pass following order :
