ORDER BELOW EXH.1
1. On 28.04.2023, the accused appeared before jail court at M.C.P.
Arthur Road, Mumbai. The accused pleaded guilty to the offence.
2. He is totally made aware of the consequences of the pleading guilty
to the offence. Despite that he is ready to plead guilty. His plea is
voluntary.
3. Heard him on the point of sentence. He prayed for leniency.
Accused is in custody since 07.03.2023. Accused had stolen wallet
containing cash of Rs.23,320/- along with documents and A.T.M. card.
The period undergone is disproportionate to the possible punishment.
Therefore, considering the nature of offence and his prayer, following
order :
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Section 379 of Indian Penal
Code and sentenced to suffer simple imprisonment for one month and
fifteen days.
B. He is entitled to set off as per Section 428 of the Code of Criminal
Procedure. As he is in jail since 07.03.2023, the punishment has already
been undergone by him, therefore, he shall be released forthwith if not
required in any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
