COMMON ORDER BELOW EXH.1
(In C.C.No.27 SW 2020 to C.C.No.51 SW 2020)
1. Perused record. Heard Ld. Advocate for the complainant/applicant,
a public sector bank.
2. All these matters are filed by the bank against the proposed accused
persons seeking directions to register the First Information Report and
investigate all these matters, as per Section 156(3) of Code of Criminal
Procedure.
3. Alleged offences are cognizable in nature. Applications are
supported by affidavits.
4. The summary of the allegations is that the complainant bank
disbursed various loans as mentioned in these matters to the proposed
accused persons under various heads after verifying documents. Later on
the proposed accused persons committed default in payment of the
installments. During recovery proceedings it is transpired that the accused
persons created fake profiles, forged various documents, committed fraud
on the complainant bank and obtained loans. There whereabouts are still
unknown.
5. The allegations are supported by the ample documentary evidence.
The collective stake involved is very high. It is a public money. Thorough
investigation in all these matters is necessary. Proposed investigation
involves so many intricacies from interrogation to collection of relevant
material, which is not possible without the help of competent police.
Therefore, prayer sought needs to be allowed. However, rather than
ordering registration of separate First Information Report in all the
matters, registration of common F.I.R. in all the matters will serve the
purpose. Therefore, following order -

ORDER
A. All the applications are allowed.
B. The P.S.O. Bandra, Mumbai, is herewith directed to register the
common First Information Report (one single F.I.R.), in all the matters at
the instance of present Branch Manager Mrs. Shiksha Sharma or any
other person authorized by complainant bank, for relevant offences
punishable under provisions of Indian Penal Code and other laws and
investigate all the matters as per Section 156(3) of Code of Criminal
Procedure.
C. The certified copy of the application Exh.1, in all the matters along
with documents produced shall be sent to concerned police station.
D. Copy of this order shall be kept in all the matters.
E. All the matters disposed off.
