ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
CRIME NO. 181/2020, NOTICE NO.315/N/2020 OF BKC POLICE
STATION
1. The present application is filed for return of vehicle i.e.
Suzuki Access bearing No.MH01DH1275, seized by the BKC police
Station in C.R.No.181/2020 registered u/sec.353, 337, 279, 188, 269 of
IPC, 134 of M.V. Act, 51 of Disaster Management Act.
2. The Investigating Officer has objected return the vehicle.
3. The applicant claims that she is the owner of the said
vehicle. She has produced copies of registration certificate, Insurance
and Aadhar card in support of her version. It seems that the applicant is
the mother of the accused. The accused has committed serious offence
with the aid of the said vehicle. The I.O. stated that the accused is
alleged in another offence u/s. 392 of IPC vide C.R. No. 8/2017 and
u/s. 379 vide C.R. No. 426/2017 registered with Mahim Police Station.
He apprehends commission of further offences by the accused with the
aid of said vehicle. The accused has criminal antecedents. Thus, the
apprehension of the I.O. appears to have substance. Further, the
offence with which the accused is alleged is Sessions triable offence.
Thus, it will not be proper to release the vehicle. As such following
order is passed:
ORDER
The Application is rejected.
